3. Orders and Acceptance
All orders, rentals, and agreements are subject to acceptance by A & R Containers Pty Ltd.
We reserve the right to refuse or cancel any order where:
- Payment has not been received
- Incorrect pricing or information is displayed
- Delivery is not feasible
4. Pricing and Payments
All prices are listed in Australian Dollars (AUD) unless otherwise stated.
Payments must be made in accordance with the invoice or agreement issued.
Delivery and upfront payments must be received in full before delivery is arranged.
5. Delivery
Delivery timeframes are estimates only and may vary due to factors outside our control.
The customer is responsible for:
- Providing clear and accessible delivery locations
- Ensuring the site is suitable for container delivery
We are not liable for delays caused by access issues or site conditions.
6. Risk and Responsibility
Risk in the container transfers to the customer upon delivery.
For rentals and rental-to-own agreements, the customer is responsible for:
- Loss, theft, or damage
- Ongoing care and maintenance
- Use of the container for lawful purposes only
7. Ownership
Ownership of containers remains with A & R Containers Pty Ltd until:
- Full payment has been received for outright purchases, or
- All payments under a rental-to-own agreement have been completed
8. Cancellations and Refunds
Cancellations and refunds are subject to our Returns & Refunds Policy.
Delivery fees are non-refundable once delivery has been completed, unless required by Australian Consumer Law.
9. Limitation of Liability
To the maximum extent permitted by law, A & R Containers Pty Ltd is not liable for:
- Indirect or consequential loss
- Loss of profits or business interruption
- Damage resulting from misuse of the container
Nothing in these Terms limits rights under Australian Consumer Law.
10. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law.
You are entitled to a replacement or refund for major failures and compensation for any other reasonably foreseeable loss or damage.
11. Privacy
Personal information is handled in accordance with our Privacy Policy.
12. Changes to Terms
We may update these Terms and Conditions at any time.
Updated terms will be published on our website and take effect immediately.
13. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia.
